General terms and conditions of sale



1. Purpose
These general terms and conditions define the rights and obligations of the parties in the context of the remote reservation of services offered by LA BEYTINA on its Website and Mobile Services.
They govern all the steps necessary for the reservation and the follow-up of the reservation between the contracting parties.
Any reservation therefore implies the client's full and unconditional acceptance of these terms and conditions.
All clients acknowledge that they have the capacity to contract, i.e. that they are of legal age and are not under guardianship.

The names "LA BEYTINA" and "LA BEYTINA.COM" refer throughout this text to the site named www.labeytina.com and corresponding to the domain name that can be accessed at www.labeytina.com

2. Scope of Application
The present general terms and conditions of sale apply to all reservations made via the Internet, through the Website or the Mobile Services and its partners.

3. Opposability of the general conditions
In any case, the version of the general terms and conditions of sale enforceable against the customer is the one in force at the time of his reservation on the Website or the Mobile Services or with its partners.

4. Reservation
Reservations can be made on the website, by telephone, by e-mail or by post.
The reservation will only be effective if it is guaranteed by the customer, either by communicating a credit card number with a validity date or by paying a deposit, and after receiving a detailed reservation confirmation.
Payment for all services must be made directly to the establishment (except for reservations that are prepaid at the time of booking).
The establishment reserves the right to refuse any reservation if the credit card number is incorrect or the reservation is incomplete.
Reservations from all sources are payable in Euros only.
The establishment accepts the following credit cards: Visa, Mastercard and American Express, and has a secure reservation system (SSL) that protects and encrypts all sensitive data transmitted to the reservation to prevent disclosure to a third party.
Upon registration of the reservation, a credit card charge authorization will be made. This will be done for informational purposes, and will in no way be a charge to the account except in the following cases:
- "non-cancelable-non-refundable" promotional offer.
- If the credit card validity date is prior to the arrival date.
if the arrival date is more than 30 days from the reservation date.
The client is solely responsible for the choice of services and their suitability for his/her needs, so that the establishment cannot be held responsible in this regard.

5. Payment
The client must come to the establishment with the credit card used to guarantee the reservation or to make the prepayment.
The establishment may also ask the client to show proof of identity in order to prevent credit card fraud.
The payment is debited at the establishment during the stay, except in the case of special conditions or rates where the payment is debited at the time of reservation (online prepayment on certain rates). This prepayment is referred to as a deposit.
In the case of a non-prepaid online rate, the establishment may ask the client, upon arrival, for a security deposit or authorization to charge the credit card, in order to guarantee the payment of the amounts corresponding to the services consumed on site.

Three methods of payment of the deposit are possible:

-either by bank transfer.
- or by check made out to the establishment and sent directly to the establishment
- or by credit card.
In this case, the reservation becomes firm and definitive only upon receipt of the deposit by the establishment, within the given time limit.
The payment of the balance of the stay will be made on the spot at the establishment.

Any travel organization, or person wishing to reserve all the rooms of the guest house, for a stay of 2 nights or more, will have to pay a deposit corresponding to 50% of the total amount, at the time of the reservation, and the payment of the balance will have to be made 1 month before the arrival of the stay.

6. Right of withdrawal
The client is reminded, in accordance with article L. 121-21-8 12° of the French Consumer Code, that he/she does not have the right of withdrawal provided for in article L. 121-21 of the French Consumer Code.
The Sales Conditions of the reserved fare specify the modalities of cancellation and/or modification of the reservation.

7. Modification of the stay
Any modification of the reservation must be requested by email or by phone. The request will only become effective once the establishment has confirmed its acceptance in writing.
In case of modification of the stay, the following conditions apply (except in case of force majeure)
- In case of no-show on the scheduled arrival date, your credit card will be charged for the first night.
- Any stay started is fully due.

8. Cancellation of stay
Any cancellation of a reservation must be requested by email to the establishment or by phone. The request will only become effective once the establishment has confirmed its acceptance in writing.
In case of cancellation of a stay, the following conditions apply (except in cases of force majeure):
- For any request made within 24 hours of the scheduled arrival date, the amount of the first night will be charged.
- In case of no-show on the scheduled arrival date, your credit card will be charged for the first night.
- Any stay started is due in full.

Concerning the deposit paid for the reservation of all the rooms of the guest house, by a travel agency or a private individual, the schedule below will be applied.

-For a cancellation at least 2 months before the scheduled date, the refund will be total.

-For a cancellation between 1 and 2 months before the planned date, we will refund 50% of the deposit.

-If the cancellation occurs at least 1 month or less, before the date of rental, we keep the entire deposit.

9. Force majeure
Force majeure is any event external to the parties that is unforeseeable, insurmountable and external to the parties and that prevents either the client or the establishment from fulfilling all or part of the obligations stipulated in the contract.
Are considered as force majeure or fortuitous event those usually recognized by the jurisprudence of the French Courts and Tribunals.
Each party shall not be liable to the other party in the event of non-performance of its obligations resulting from an event of force majeure.
It is expressly agreed that force majeure suspends, for the parties, the performance of their mutual obligations and that each party shall bear the costs arising therefrom.

10. Prices
The prices are indicated in Euros.
VAT is always included.
The prices indicated include only the services strictly mentioned in the reservation.
To the price mentioned in the reservation will be added, at the time of invoicing, the additional services provided by the establishment during the stay and, if necessary, the tourist tax.
The applicable prices are those in effect on the day of the reservation. The establishments, independent professionals, are free to change their prices at any time. Only the price indicated in the reservation confirmation is contractual.

11. Complaints, disputes
All complaints must be made to the establishment within 7 days of the date of stay.
In the absence of recourse to the conventional mediation procedure or to any alternative method of settling disputes within a period of 30 days, each of the parties may refer the matter to the competent legal jurisdiction.

12. Responsibilities
It is the responsibility of the Establishment to take out all guarantees and insurance necessary for the reception of the public in its Establishment and for the exercise of its activity.
The responsibility of the establishment is limited in case of theft of goods or objects when they have been entrusted to its custody only.
The client must ensure the custody of his goods and materials. The client must inform the establishment of any damage caused by him/her. The client is responsible for all damages caused by his intermediary and undertakes, in case of damage to the premises (room, common areas such as swimming pool, jacuzzi, garden, lounge, sanitary facilities) to bear the costs of repair.
Also, any behavior contrary to good morals and public order will lead the establishment to ask the client to leave the establishment without any compensation or without any refund if a payment has already been made. If no payment has been made, the client must pay the price of the nights consumed before leaving the establishment.
The client agrees not to invite any person whose behavior is likely to be prejudicial to the establishment, the latter reserving the right to intervene if necessary. The client may not bring in any outside drinks or foodstuffs without prior authorization from the management. The client agrees to ensure that participants and their guests respect all the rules and regulations of the establishment (especially the smoking ban). The client shall ensure that the participants do not disturb the operation of the establishment or jeopardize the safety of the establishment and the people in it.
Unless otherwise expressly agreed, the client must leave the room before 11:00 a.m. on the day the reservation ends. Failure to do so will result in an additional night's charge.
LA BEYTINA does not accept animals.
LA BEYTINA offers a free WIFI access allowing customers to connect to the internet. The client agrees that the computer resources made available by the establishment will not be used in any way for the purposes of reproduction, representation, provision or communication to the public of works or objects protected by copyright or by a related right, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code, when such authorization is required. If the customer does not comply with the above obligations, he or she may be charged with an infringement of copyright (Article L.335-3 of the Intellectual Property Code), punishable by a fine of 300,000 euros and three years imprisonment. The customer is also required to comply with the security policy of the establishment's Internet service provider, including the rules for using the security measures implemented to prevent the illicit use of computer resources and to refrain from any act that undermines the effectiveness of these measures.
The photographs presented on the Site and the Mobile Services of the establishment or those of the partners are merely indicative. Although every effort is made to ensure that the photographs, graphics and texts reproduced to illustrate the establishments presented give as accurate an idea as possible of the accommodation services offered, variations may occur, particularly due to changes in furniture or possible renovations.
The establishment cannot be held responsible for the non-execution or the bad execution of the reservation in case of force majeure, the fact of the third party, unforeseeable and insurmountable, the fact of the customer, in particular the unavailability of the Internet network, impossibility of access to the website, external intrusion, computer viruses or in case of unauthorized prepayment by the bearer bank.

13. Displacement
In the event of an exceptional event or the impossibility of making the reserved room available to the client or in the event of force majeure, the establishment reserves the possibility of accommodating the client in whole or in part in an establishment of an equivalent category, for services of the same nature and subject to the prior agreement of the client.
The possible additional cost of the room, transportation between the two establishments and a telephone call remain the responsibility of the establishment.

14. Mediation
The decree of October 30, 2015 on the mediation of consumer disputes, which transposes into French law Directive 2013/11/EU of May 21, 2013 on the out-of-court settlement of consumer disputes, and Order No. 2015-1033 of August 20, 2015 on the out-of-court settlement of consumer disputes, specify the conditions of application of Article L152-1 of the Consumer Code, which requires professionals in all consumer sectors to offer a mediation procedure in the event of a dispute with their customers. According to the law, the outcome of the mediation must be reached within 90 days. We invite you to formulate your requests exclusively by e-mail which will bring a dating of your correspondence and to keep a personal file of it.
Internal mediation
For all disputes that have not been resolved, we invite you to contact the Internal Mediation Service, which undertakes to provide you with a satisfactory response within 30 days.
In the event of dissatisfaction, you are advised to contact an external mediator of your choice.

These terms and conditions of sale are subject to French and European law.

We collect and archive our exchanges in order to better serve you and to optimize our customer relationship.

We do not collect or archive any sound data

We collect your customer testimonials in video, posted by yourself and with your agreement, on our Facebook page and or Youtube. These videos are found on our site with your agreement and within the framework of the legislation.

We collect and publish or moderate your opinions and comments within the framework of the legislation. Refusals are also archived as a legislative control.

Data retention
Your data is retained for different periods of time and for different reasons depending on the type of information.
These retention periods are a legal obligation in the commercial, tax and banking legislation.
Cookies are kept for a maximum legal period of 13 months, but we have opted for a retention period of 60 days.
Your account information and order invoices are kept for 10 years as a legal and accounting obligation from the end of the fiscal year.
Payment information is not collected on our site, but is kept with our bank and yours for a legal period of 5 years.
